Credit problems can come about in different ways, but they all end up with a debt collector calling you for the money that is owed.

How did your credit problem come about, were you laid off from your job, maybe an unexpected illness side tracked you. Lets say your credit problem was due to being laid off, and now you are working again but you don’t earn the same amount of money.

Maybe you are willing to work out a payment plan with the debt collector but the payment arrangement is unacceptable. The repayment amount offered would take too long to pay off the debt. Send the payment anyway the debt collector still have to credit the account.

When a debt collector calls don’t duck the call, there is certain information you will need from the debt collector. Remember you have to talk to the debt collector to see if they are in fact harassing you.

How do you know if a debt collector is harassing you? If the debt collector is calling you before 8:00 AM your time and after 9:00 PM your time that is harassment.

If you have asked the debt collector to stop calling you and you have put the request in writing and sent the letter via certified mail, and the debt collector is still calling you that’s harassment.

Did the debt collector leave a message with your neighbor? That in it self is not considered harassment. If the debt collector left a message with the neighbor saying you owed thousands of dollars that would be in violation of the Fair Debt Law.

Can you act against a debt collector who has harassed you? Sure you can you can sue the company the debt collector is representing and the debtor collector. The Collection Company would receive a fine and the debt collector would be fined for each violation. Please see the Stop Harassment page.

You can contact your local attorney generals office to get the forms to file a formal complaint against the Collection Company and the debt collector. Remember to keep a detailed log of all the times the debt collector called, what was said, and your response. The log should include the date and time of said calls.

You don’t have to be harassed by debt collectors, with time and patience you can have your credit problem cleared up. In the meantime try to work out a reasonable payment plan with the debt collector.
